What are the purposes of processing hotel guests’ personal data?

The purpose for which the Hotel processes personal data is the conclusion and performance of a hotel service agreement. In addition, the purposes of processing personal data by the Hotel are:

  1. pursuing any claims by the Hotel in connection with damage caused by the Guest, or defending against claims made by the Guest against the Hotel,
  2. documenting the provision of services for tax purposes,
  3. ensuring the highest quality of services for hotel Guests.

If the Guest has given consent for the processing of personal data for marketing purposes, the Hotel processes personal data this purpose, namely to send the Guest marketing information and offers about its products and services.
Furthermore, the Hotel processes the personal data of Guests collected through hotel surveillance systems to ensure the safety of hotel Guests and other persons present on the hotel premise

What is the legal basis for processing personal data?

The legal basis for processing personal data obtained by the hotel is the hotel service agreement. 

The legal basis for processing personal data for marketing purposes is the guest’s consent. The hotel informs that consent can be withdrawn at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

The legal basis for processing personal data collected via video surveillance is the protection of the vital interests of the guest and other individuals, as well as the legitimate interests of the controller. The legal basis for processing personal data to ensure the highest quality of services is the legitimate interests of the controller.

Who may receive personal data?

The hotel may disclose personal data to the following categories of entities:

  1. companies providing IT support services and software for the hotel,
  2. Accounting firms providing bookkeeping services,
  3. transportation and taxi companies in the event a guest orders transportation or courier services,
  4. legal firms providing legal advice and representation services.

How long will personal data be processed?

Personal data:

  1. obtained in connection with a hotel service agreement will be processed for the duration of the statute of limitations for tax claims or civil claims of the hotel or the guest, whichever occurs later,
  2. obtained based on consent for marketing purposes will be processed for the period of validity of that consent,
  3. obtained through video surveillance will be processed for 30 days from the date of recording, and will then be permanently deleted.

What rights does the guest have regarding the processing of personal data?

Each guest has the right to access, correct, delete, or restrict the processing of their personal data. Furthermore, each guest has the right to object to the processing. Access to data is possible at the hotel’s registered office. Additionally, the hotel provides the email address rodo@hotelbeethoven.pl for matters related to personal data.

Is it possible to lodge a complaint regarding the processing of personal data?

Yes, each guest has the right to lodge a complaint with the supervisory authority, which is: The Inspector General for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw, Poland.

Will the hotel transfer personal data outside the EEA?

No, the hotel does not intend to transfer personal data outside the European Economic Area (EEA).

Is providing personal data a contractual or statutory requirement?

Providing personal data, including name, surname, and address, is a requirement for concluding a hotel service agreement. Failure to provide personal data will prevent the hotel from entering into a hotel service agreement.

Are automated decisions, including profiling, made based on personal data?

No. The hotel does not make automated decisions based on personal data, including profiling.
